Canada Brings Forth New Legislation to Gain ‘Citizenship by Descent’

Canada has decided to make changes to its Citizenship Act, which will allow gaining citizenship by descent.

The IRCC announced the legislation, Bill C-3, An Act to Amend the Citizenship Act. Bill C-3 would grant Canadian citizenship to anyone who would qualify as a citizen today if not for the first-generation limit.

The first-generation limit doesn’t permit citizenship to children who are born or adopted outside the country, even if their parents are Canadian citizens.

The proposed legislation would also permit citizenship beyond the first generation, as long as the Canadian parent has a substantial connection to Canada by having stayed for at least 1,095 cumulative days before the child’s birth or adoption.

According to the news release by the government, the “current first-generation limit to citizenship no longer reflects how Canadian families live today.”

But first, the legislation must receive approval from the House of Commons and the Senate, and then pass the Royal Assent.
